The American Choice Awards voting and research is based on experiences and perceptions of consumers and do not reflect the opinions of The American Choice Awards. Winners receiving the highest numerical scores within each category’s attributes and criteria are not necessarily statistically significant and may not necessarily reflect the actual market. The consumers’ experiences with the winning product and brands may vary. The winners of each category are determined by consumer voting, surveys and opinion aggregation based on a proprietary methodology developed by The American Choice Awards. The methodology may include additional criteria such as Recommendation Likelihood, Perceived Sustainability, Purchase Consideration, Product and Brand Appeal, Familiarity, Perceived Quality and Perceived Value, as well as category-specific criteria and perceived appeal from people who had either purchased or used the products, brands or services, or have formed opinions based on anecdotal evidence or feedback of others. The American Choice Awards does not represent nor warrant that any individual consumer experience will be consistent with the results of the voting, surveys and any accompanying research. The American Choice Awards reports the results from the consumer voting, aggregation and surveys, and does not warrant nor represent the quality or satisfaction with, or efficacy or safety of, any individual product or brand. Any and all responsibility for quality, performance or safety of any product or brand rests with the individual manufacturer or participant. The American Choice Awards shall use efforts to ensure the security and accuracy of all votes and the voting process, however, such methodologies are not infallible, and The American Choice Awards makes no guarantee as to their accuracy or effectiveness. The American Choice Awards is not liable for any perceived or actual defect in the quality, performance, efficacy or safety of any product, or any injury or death resulting, or alleged to have resulted. Best Brand competition participants agree that consumer research data, identities of non-winners, other participants, and any and all information related to the results, techniques, presentations, categories, questionnaires, processes, registration, media campaigns, vendors, participation agreements and/or media agreements and licensing agreements provided to the participants whether written or oral or otherwise supplied shall be treated by the participant as confidential. Participants agree that they will not, at any time, make, directly or indirectly, any oral or written public statements that are disparaging or derogatory about the other nominees, winners, participants, non-winners, research results, research methodology, categories, processes, vendors, media outlets, media campaigns, talent, awards, The American Choice Awards, or its employees or officers. Agreements shall be construed pursuant to the laws of the State of Delaware. The American Choice Awards retains the right to change without notice vendors, processes, schedules, timelines, spokespeople, award presenters, talent, media distribution, methodologies, competition, timeline, structure, systems, awards titles, or any other aspect as it deems necessary.

 

Advertising and Promotion

 

The American Choice Awards maintains the right to feature winners and their logos and service marks in advertising and publicity efforts in conjunction with the American Choice Awards, Best Brand Award throughout the term of the contest and awards publicity. The activities may include but are not limited to photographs, illustrations, film, video, digital reproduction and depiction of the winning brands and products, labels, packaging and trademarks. Media distribution may include but is not limited to television, print and digital publications, social media, blogs, websites, retail promotions, mobile apps and other methods deemed appropriate by The American Choice Awards. Likewise, upon confirmation and receipt of the official artwork, participants may promote and publicize their nominations, wins, trophies, official logos and “American Choice Awards Best Brand” tagline (and approved variations) in any and all communications. Winners must use the official Seal, and the accompanying winning category name provided by The American Choice Awards. Any and all advertising regardless of format or distribution method which includes the Best Brand Seal requires prior written approval from The American Choice Awards.

The American Choice Awards, its affiliates, voting, polling, research, promotion and advertising partners, vendors and other relevant entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, the Site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of voting information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to vote, including any injury or damage to participant’s or any other person’s computer or mobile device relating to or resulting from participating in the voting or downloading any materials. The American Choice Awards is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically flawed or misdirected votes, which will be disqualified.
